These terms govern all quotes, orders and sales by JVS Timber in Australia and are drafted to comply with the Australian Consumer Law (ACL) and Victorian law. Replace bracketed items before publishing.

1. About these terms

  1. These Terms & Conditions apply to all quotes, orders, sales, deliveries and collections by JVS Timber trading as JVS Timber, (“JVS Timber”, “we”, “us”).
  2. “Customer” or “you” means the person, business or company that requests a quote or places an order, including trade account holders.
  3. “Goods” means timber, hardwood, pine, plywood, LVL, formwork and any other products we supply. “Services” means cutting, delivery and related work.
  4. By requesting a quote, placing an order, accepting delivery or using this website, you accept these terms.
  5. Nothing in these terms excludes, restricts or modifies any right you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, that cannot lawfully be excluded.
  6. We may update these terms at any time. The version on our website when you place an order applies to that order.

2. Quotes, orders and pricing

  1. Quotes are valid for [14] days from issue and are subject to stock availability at the time of order.
  2. All prices are in Australian dollars (AUD) and include GST unless stated otherwise, as required by the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
  3. Delivery, cutting, freight and handling charges are extra unless shown on the quote.
  4. An order is accepted only when we confirm it in writing (email or invoice) or supply the Goods.
  5. We may decline any order. If we cannot supply, we will refund any amount you have paid for that order.
  6. Timber prices change with the market. If a price changes after the quote expires, we will tell you before supply and you may cancel without charge.
  7. Errors in pricing or descriptions on our website or quotes may be corrected. If this affects your order, you may cancel and receive a full refund.

3. Payment and trade accounts

  1. Cash and DIY customers must pay in full before collection or delivery, unless agreed in writing.
  2. Accepted methods: [bank transfer, credit/debit card, EFT]. Card surcharges, if any, will not exceed our cost of acceptance, as required by the RBA surcharging standard.
  3. Trade accounts are subject to an approved credit application. Unless otherwise agreed, payment is due [30 days from end of month] of invoice.
  4. Special orders, custom cuts and non-stock items may require a deposit of [50]% before we order or process them.

4. Delivery and collection

  1. We deliver across greater Melbourne and to regional Victoria and interstate via freight partners. Delivery dates are estimates; we will tell you promptly about any delay.
  2. You must provide the correct site address, safe vehicle access, and a clear, level unloading area. Tell us about narrow driveways, overhead obstructions or restricted access before delivery.
  3. Goods are unloaded at the nearest safe point the driver can reach. We are not responsible for moving Goods beyond that point.
  4. If delivery fails because the site is inaccessible or unsafe, or no one is present when required, a redelivery fee may apply.
  5. Collection is from 7 Westside Dr, Laverton North VIC 3026, Monday to Friday 7:30 am to 3:00 pm. Confirm your order is ready before you travel. You must bring a vehicle and load restraints suitable for the Goods.
  6. You must inspect Goods on delivery or collection and report any visible damage, shortage or wrong item within [48 hours].
  7. Under Victorian chain of responsibility and load-restraint rules, you are responsible for safely restraining Goods you collect.

5. Risk and ownership

  1. Risk in the Goods passes to you on delivery to the site or on collection.
  2. Ownership of the Goods stays with JVS Timber until you have paid all amounts owed to us in full.
  3. For trade accounts, you agree that these terms create a security interest in the Goods and their proceeds under the Personal Property Securities Act 2009 (Cth) (PPSA). We may register this interest on the PPS Register, and you agree to sign any document needed to do so.
  4. If you do not pay when due, we may enter your premises or site, with reasonable notice, to recover unpaid Goods that have not been incorporated into a building.

6. Timber as a natural product

  1. Timber is a natural material. Variation in colour, grain, gum veins, knots, insect marks, moisture content and minor dimensional movement is normal and is not a defect.
  2. Product images and samples are a guide only. Supplied timber may differ in appearance.
  3. Grades and stress ratings (such as F17, F27, MGP10, MGP12, LVL E10/E14) are supplied to the relevant Australian Standards, including AS 2082, AS 2858 and AS/NZS 4357, where stated on the product.
  4. Hardwood flooring and decking must be stored, acclimatised, installed and finished according to manufacturer and industry guidelines (for example, AS 1684 for framing and AS 1884 for flooring installation). Defects caused by poor storage, installation or maintenance are not covered.
  5. Treated pine must be used for its stated hazard class (H2 to H5) under AS 1604. Follow safety guidance when cutting treated timber.

7. Cutting and suitability

  1. Cutting to length is available on some products and may incur a charge. Cut lengths are subject to normal saw tolerances.
  2. Cut-to-length, special-order and custom items cannot be returned unless faulty.
  3. Our staff can give general product information, but it is not engineering or building advice. You are responsible for choosing Goods that meet your plans, the National Construction Code, and the advice of your engineer or registered building practitioner.

8. Returns, refunds and your consumer rights

  1. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
  2. Faulty or incorrect Goods: contact us with your invoice number and photos. We will assess the claim and offer a remedy as required by the ACL.
  3. Change of mind: unused, undamaged, standard stock items in resaleable condition may be returned within [7] days with proof of purchase, at our discretion. A restocking fee of up to [15]% and any freight costs may apply.
  4. Not returnable for change of mind: cut-to-length, special-order, custom, treated-to-order, oiled or coated items, and Goods that have been installed, stored outdoors or exposed to weather.
  5. Refunds are paid to the original payment method.
  6. Where Goods are bought for business use and are not of a kind ordinarily acquired for personal or household use, and the price exceeds $100,000, our liability is limited (to the extent the ACL allows) to replacing or repairing the Goods or paying the cost of doing so.

9. Liability

  1. To the extent permitted by law, including the ACL, we are not liable for indirect or consequential loss, such as loss of profit, labour costs, or delays to your project.
